Trooper in Scuffle with Paramedic Still On Leave

| Wednesday, July 22, 2009

OKLAHOMA CITY (AP) - An investigation into a roadside scuffle between a state trooper and a paramedic that was caught on video is still under review nearly two months later, and the attorney for one of the men is complaining about the lack of action.

Trooper Daniel Martin has been on paid administrative leave since June 1, after a video of the May 24 incident with Creek Nation paramedic Maurice White Jr. surfaced.

White filed a federal civil suit Tuesday against Martin, accusing him of violating his civil rights and "throttling him by the neck" during a traffic stop. He is seeking more than $10,000 in compensatory and punitive damages.

Martin's attorney, Gary James, says White does not have a valid claim under federal civil law.

"There's no doubt this is a slow play," White's attorney, Richard O'Carroll, said before filing the suit. "They're just hoping to stall long enough so that you guys (the media) will stop asking questions. Well, we're tired of the games. We're not waiting any longer."
